With the exception of money, IDCC will not lose anything by settling for less than every dollar that they are owed by ERICY. The facts of life are that we got screwed in the MOT trial. We can moan and groan about that till eternity, but, that is history. With that history, we are lucky to be where we are at. IDCC had been written off for dead, after that debacle. Our management deserves credit for having seen the prior errors and having had the good sense to have the subject patents reviewed and reaffirmed by the USPTO and other foreign agencies.
There are none among us who don't agree that the future is rosy for IDCC. There are seemingly going to be much better regulatory agencies enforcing patent rights to 3G, than there have been in the past.
The impasse with ERICY is causing worldwide ramifications to the telecom sector. It becomes increasingly evident that NOK and Samsung are tied to the ERICY resolution and by the dearth of other litigation, it appears that the "other infringers" are party to an understanding that they will sign up when ERICY does. It is time to take a reasonable settlement and move on.
