According to the NY Court system there is now only one system, so the filings should be available as filed.


The Distinction Between CM/ECF and PACER
The CM/ECF (Electronic Case Filing) system is for the benefit of practicing attorneys. It permits them to file documents electronically with the court instead of sending them down here on paper and to receive notification via email of filings made by other parties or chambers. It also permits an attorney to obtain and view documents that have been filed in cases with which the attorney is not involved, subjecting him or her to most of the same fee requirements and restrictions as the general public, described below.

The PACER (Public Access to Court Electronic Records) system permits the general public, for a fee, to obtain and view documents that have been filed with the court in civil cases only. It does not permit the general public or pro se litigants to submit documents to the court. It does not provide access to criminal case documents, or to documents that have been placed under seal, at all.

Formerly these had been two completely different computer systems, each requiring its own unique username and password. Nowadays, PACER features have been incorporated into the new CM/ECF. The two systems are now one, but the names linger.

For the convenience of those who already possess PACER accounts, the usernames and passwords from PACER have been incorporated into the CM/ECF system.
