#121181 RE: IDoCare #121179

If I'm SAM I'm happy for NOK to pick up the tab. I don't have to pay for laywers, I don't have to waste too much time. I just have a status report done by some lawyer and I wait. Same with all the other non payers. It is to their competitive advantage to let NOK carry the fight and to NOK's disadvantage. But it is still cheaper for all to let NOK carry the fight for the rest of the industry.

MOT first picked up the tab. Then ERICY. Now it is NOK's turn. Could be they are in cahoots, or just the way the IPR world works. I personally think there is racketeering and price fixing going on, but I think most anyone would be hard pressed to prove it.

This is just the way the cards have been dealt in the current IPR game.

Once NOK begins to pay IDCC, I wonder how the rest of the Industry will act. NOK will then be at a competitive disadvantage to the rest of the industry.

IDoCare, Nokia does what they do for their own benefit.

The arbitration has resulted in a substantially lower balance due Interdigital from Nokia than what many of us had expected. Nokia "won" in the sense that they owe so much less.

IMO, it certainly was possible that Nokia could have negotiated this rate in the past, but instead Nokia believed that they could possibly walk away without owing anything as they had previously stated in their admission that they didn't expect Ericson to sign. I also believe this is just a continuation of the war being waged by Nokia to cap rates. Interdigital is definitely playing in the big leagues at this point and they have no intention of going back to the minors. But you have big hitters in the big leagues, and you have to bring your best game if you intend to win.

Nokia doesn't need to be in some conspiracy (cahoots) with other companies, because I doubt Nokia cares how the other companies fair in such cases. Nokia does what they believe to be best for Nokia, period.

Though the dollar amount is substantial for Interdigital and for those of us who are long IDCC, it is still a small amount in the overall picture of what Nokia could owe for the coming years for the many patents that they will use in their products.

That's the game as I see it. Others may disagree, but regardless, I do expect that Interdigital will be paid for their patents because those patents are essential and part of the standards. Interdigital has WON in arbitration, and the courts tend to support such cases.

Good luck to the longs.

IMO of course.
