From the same web site, in the story about Chiron vs Genentech comes the following:

"Having also been persuaded by the theme of 'Confusion in the Patent Office', after eight hours of deliberations the jury members unanimously agreed that counsel had met the burden of 'clear and convincing evidence' and found for Genentech on all counts, surprising pundits by breaking the Chiron patent, eliminating their claim for royalties, and truncating the trial after the initial phase."

Just to prove, once again, that with a jury there is no certainty.
