Order of Transfer in Ericsson Litigation

On December 12, 2002, an order was entered in the United States District Court for the Northern District of Texas at the request of Judge Barefoot Sanders that the case of Ericsson Radio Systems, Inc v. InterDigital Communications Corporation be transferred to Judge Barbara M. G. Lynn in the same Federal District Court. The order further specified that the case remain on its current pretrial and trial schedule subject to any modifications that Judge Lynn may direct. The commencement date for the trial remains February 10, 2003.

Harris v. Ericsson
Recently, long-time Focal Point client, Harris Corporation, successfully asserted its patent involving cellular telephone communications technology against Ericsson, Inc. A federal jury in Dallas, TX found Ericsson liable for willfull infringement and awarded Harris a $61 million verdict. Harris held a patent on a method for equalizing transmitted radio signals that became scrambled and distorted as a result of traveling through the atmosphere and then converted those signals into recognizable speech in a cellular phone. Harris pioneered this technology for the U.S. military in the 1980's.

The Focal Point worked very closely with both San Francisco based counsel and local counsel in Dallas during all phases of this litigation: from working with lead expert witnesses in preparation for a Markman Hearing, to creating technology tutorial slides for the Motion for Summary Judgment hearings, all the way to a mock jury, for which a significant amount of graphics were created based on the arguments of both Plaintiff and Defendant. The Focal Point also worked in partnership with counsel to develop a neutral patent tutorial that taught the mock jury key concepts regarding the USPTO and the patent system in general. The Focal Point then went on to adapt all of the aforementioned graphic modules into a seamless and presuasive trial presentation.
