Large, it is an interesting viewpoint that Susman would be working "behind the scenes" with TPS. However, why be on board with a settlement, quoting that the EC and counsel are very happy/support the plan, the mediator was very effective, and so forth when they could've easily stated that they tried and worked very closely with the debtors to resolve all issues but was unsuccessful? Thus, the EC showed that they've made a true effort but since it did not yield any fruit, will now join DIMEQs and TPS in opposing the DS/POR. Wouldn't this be the way to go?

LG..Since THJMW ruled that TPs was now in the preferreds camp..i.e exchange event took place, then TPS most likely would have been in contact with EC, because the EC represents all equity interests and TPS is a preferred equity interest as of now... What we want is for TPS ruling to be overturned and they can in turn be dumped abck into JPMC's lap. But, until then the EC represents them.
