The former settlement that failed, had the SNHs providing loans to the Estate for litigation and other purposes. This settlement is expected (by me, and others, and referenced in court) to be an enhanced version of that -- so it is plausible that the similar framework is in place...
Somebody can find the media reports or Rosen's in-court description of the two (or three?) loans coming from the SNHs in the former settlement.
