Thanks, Loop.

It appears the panel took a little license by not declaring Nokia in default.

Seems like everyone knew the trigger was pulled but the Viper Pit in Espoo.

And I'll say it again. They wasted another two years of IDCC's 2G patent life, not to mention knocking-off another two years of their license agreement, and all it cost was what they owed.

loophole: Are you saying that if the award setting the rates is confirmed, then if Nokia refuses to furnish sales data, the refusal would be a dispute subject to arbitration. To my non legal mind it would seem that if required by the PLA and the award, and they refuse to furnish the data, they would be breaching the PLA and in non compliance with the award. Or are any and all disputes between the parties regarding contract terms subject to arbitration.

Loop , I’m sure I’m not the only one that just got twisted on this. But in the event I am I’m going to need a little help here.

The first arb I understand. And I did read how per contract they resolve by this use.

But then we have “The issue now is the enforceability if Nok becomes in default of the modified PLA and the authority of the Fed Dist Ct to deal with same.”

I guess I don’t understand the options they have. { possible 2nd arb? vs. court?} You see I was thinking end game and your hinting at halftime, now as much fun as it been and all if you could just break this down a little it would be great.

Note contrary to what Nicmar mentioned about Minnesota and the cold it’s about 90 something today. Couple more weeks of this and the ice will be off the lakes. LOL.
