A few things to remember before you get TOO excited . . .
1) Intent is harder to prove than facts.
2) The bar for inequitable conduct is the highest: clear and convincing evidence.
3) You need to look at Teva's version for balance.
That said, I now think the chances of defendants succeeding on inequitable conduct are better than we had previously thought, about even now. But I say that without having read all the legalese; in particular, I need to read more from Teva's POV.
