It's binding.

I think Nokia will pay after Jorma has blown off his tantrum and cooler head prevail. When he realize that the odd is stacked against Nokia, he will pay to take advantage of the prepay discount - he's no fool.

Long....its as binding as it gets. The "dissent" is a red herring and is always anticipated. Even the loudest and most articulate and persuassive dissenter cannot be heard by the majority. In other words, its irrelevant.

Every Award shall be binding on the parties. By submitting the dispute to arbitration under these Rules, the parties undertake to carry out any Award without delay and shall be deemed to have waived their right to any form of recourse insofar as such waiver can validly be made


Nok is toying w/us via their PR. They know as well as everyone else, that absent outright collusion by the arbitrators, final means final. That said, unless Nok cuts us a check, there will be a delay in payment as we travel through further legal proceedings.

Also, Nok does have the right to seek clarification or correction of the award through the ICC. This is usually for clerical or calculation irregularities. Nok may be claiming that it intends to apply for correction/clarification (w/i 30 days) and that until the time period for correction passes, Idcc's petition to compel the award is premature.

The saga continues. However, it is painfully obvious that until we have cash in hand, we will not achieve the respect we deserve.
