Really by analogy with formulation patents. They always sound convincing, the holders always claim they will block everyone and everything, but in the end they never seem to amount to anything at all. Seems there is usually another way to skin the cat and circumvent them.

I've never seen a process patent block a drug before, but the enox situation is unusual, so maybe this will be a first.

Process patents are not allowed in the FDA’s Orange Book...

Can you explain what you mean by the above quote, and why such patents are not allowed?
