Perhaps Ericsson's Litigators may have convinced the Wallenberg's that although they may well settle for a 1% past royalty rate, with an eight year payout..but they feel that they will have a "slam Dunk" win..Overlooking the fact that Ericsson is exposed financially to a figure that could exceed 25% for all U.S. sales for the past twelve years..A finding of 5% becomes 10% with compounded interest..and and add treble penalties of up to 15%...Perhaps Ericsson will bring in Johnnie Cochran ..to win and influence the Jury and throw out all of IDCC's DNA evidence!

The exhibits discussed this past weekend by the board are documents that have gradually come to light over the past years of the "discovery" phase of the litigation. I doubt that any new documents have come up in the past few months. Both sides know the facts that the other side is working with. What they don't know is exactly how the other side will present their case. That gradually becomes clearer as each side's witness list is narrowed and issues regarding admissibility of certain documents are decided by the court.
