I think that what you describe is a deal made to avoid transaction costs associated with litigation, and it is likely that the compromise will be written off by the company involved.
And I have to say that my perspective is that ethics and capitalism do NOT go hand in hand.
IMHO the nice guy doesn't finish last but just doesn't finish in capitalism. If the nice guy engages in business practices that end up hurting his bottom line, his competitor is not just going to beat him but ultimately put him out of business entirely.
Legality and ethics are different. It MIGHT pay to obey the law in a capitalist environment as the penatlies and costs of failing to do so might end up creating a competetitive disadvantage. But clearly it does pay to get away with whatever one can.
IMHO capitalism is inherent Amoral. Not immoral, not moral but just amoral. Morality isn't an issue. That isn't to say that companies don't engage in charity activities and the like but please note that when doing so they reap PR and tax benefits so it is hard to show that such acts are purely generous rather than to some extent self interested.
I'm not rendering any moral judgments here, just saying that the capitalist ocean is filled with sharks and nice little fish get eaten.
