Today was a bit confusing in that there are two settlements and trials being talked about. Steinberg was referencing the adversary proceeding (formerly the Broadbill proceeding) between the LTWs and the Debtor. That's what a mediator had been appointed for several months ago, although they failed to reach a mediated settlement. On September 12, there is a trial for that case. Separate from the BK proceeding we are now awaiting some closure...settlement...on.
This is the first hearing where the two were thrown around so much...a function of the calendar and how close we might be to the resolution of each.
