Perhaps .. but I don't think it would take the CAFC all this time just to say that.

Plus ...IDCC went back and the patents passed scrutiny with the USPTO when they amended their claims ... NO?

Net: You said "I think the IDCC patents in the Nokia ITC case might be a victim of #1" which you defined as "1. The patent office has tendency to reject the patent applications whose scope was broad/generalized."

However, the USPTO granted the broad InterDigital patents in question, so your #1 presents no problem to the ITC case.
It's usually harder and more expensive and takes longer to get an essential patent, but incredibly worth it.
