You're correct beulah: it's not a 'settlement' but a component of the settlement to come.
As indicated in the Business Week article (which added some information to the articles that hit the wires earlier today:
"How much the deal is worth to shareholders can’t be easily calculated because the value of the reinsurance company they will get relies in part on future tax breaks, one of the people said.
“That is impossible to assess,” one of the people said."
Clearly, that involves NOLs, undisclosed assets and other items, in addition to the value of litigation going forward.
