I think they have had a number of so called FDA consultants, including the chairman of the company.
There is no "beating the system" as far as I can tell from researching. They do seem to be in contact regularly which is a good sign, as with any Government process you risk losing it all if you try to beat it. The FDA have to ensure they have everything documented about this new category, even if it has been submitted or the already approved recoveryRX on prescription.

as an aside I was at the PTO this evening but public search was closed or I might have looked for the new patent details and left an actipatch back for them to study there!
