Have you ever actually read a 10-K? As many have pointed out here, Overstock (and many others) claims a naked short position, but it hasn't stopped them from filing with the SEC. Why is CMKX different?

Neil Levine: Your Honor, as cmkx's auditor, I cannot sign off on their financials when proof has been presented to me that more shares are being held than exist. It would not only violate Sarbanes Oxley, but the fundamental basics of accounting for me to knowingly approve of a false figure when share are being held by shareholders that have never been accounted for. In fact no honest or reasonable CPA could sign off on such financials without risking criminal liability. Perhaps the SEC can recommend a CPA to cmkx that is willing to risk such criminal sanctions but my ethical obligations and in fact, the law, forbid me to do so.

The proof: CMKX has issued 703.5 BILLION shares. Without bothering to register most of them.

And suddenly, like a house of cards, one case after another was settled by Big Tobacco resulting in amounts numbering in the hundreds of billions of dollars.

And, as with CMKX, total BS. I'm a smoker. If I get lung cancer or emphysema, will I blame the tobacco companies? Of course not. Smoking is, and has always been, MY choice. Did I realize the dangers from the outset? Of course I did.

Urbie as Rosa Parks? Wow...you may just have qualified again.

Thanks again Zen. I appreciate the points of view you have and I also think CMKX will have what they need. After Tuesday this board and the other one will either be cheers for us or a bunch of I told you so's from the negative people. But one way or another they'll be quiet soon! I hope it's because they have both feet in their mouth. Whatever the case maybe, they can go haunt someother board and make themselves out to be the greatest fortune tellers of all time. We can go find other stocks and hope for the best with them as well, making our own decisions because it's our own money, not theirs. They buy what they want, we buy what we want.

Great post, Zen! Will send it up North, as I'm hoping to enlist Canadians in bringing maximum cross-border embarrassment to bear. Theirs is a company that's apparently being shafted by NSS-ing scum, but is fortunate to have deep-pocketed backers unlikely just to roll over and submit.

Bravo Zen! However I have a question and am seeking your opinion. Assuming the Judge hears our plea and agrees that a wrong has been committed and If the Short is as high as Trillions (With an "S"), What could be the possible remedy? I believe the free market could not handle a no ceiling PPs for CMKX stock?

Just you opine if you will on the possible outcomes.
