Naked short or not, if a big board listed company wanted to fight the NSS by NOT FILING, it would give your friends free reign to short the life out of the stock.

Byrne would never resort to that in order to prove the NSS. he doesn't have to. Afterall, Rocker is short in the 9 figures on OSTK, let's not even talk about his plight in MSO.

CMKX is different...your buddies already flatlined it long ago. CMKX had NOTHING to lose by not filing and everything to gain...this hearing is the result of your friends taking the bait, and biting hard.

Don't know about Overstock's situation, whether they could PROVE NSS ... but you can be sure CMKX doesn't intend to violate Sarbanes Oxley.
