You can get a very good idea of how a judge or panel will rule without seeing the decision yet. jmo

companies DO seek outside counsel to determine if there case may be "won".

Some of Interdigital's increase in litigation costs probably stems from getting independent readings on their case to determine what their chances are...

then Interdigital bought a whole lot of their stock back. What do you think Interdigital is thinking?

Do you think the arb panel has been looking at this for six months to decide there is no trigger? Not bloody likely.

It's a little naive to think IDCC and NOK have no info on how the arb panel ruled!
