I don't think you can say the same about a bankruptcy's DS since we don't ever really know what our own guys are going to do, let alone the debtors (though undoubtedly they are not our friends).
I don't know, my personal feeling is that Susman is a well known litigator and may be interested in somehow skipping all this crap and taking it all up in appeals and litigating this whole mess out until we get what we want. But, of course, I am not of the legal-minded crowd and am just going off a few educated guesses.
