I noticed that as well. He is concerned about a lawsuit because he sold Xtend Medical a device and never delivered it. Duncan offered for the longest time to put Sam's shares in an escrow account and make this deal happpen (in the letter he wrote the judge in the court docs). Xtend has just wanted Sam to take payment and finish the deal. It is like Sam gets 1/2 way into it and just stops. His actions prove that he was obligated to do turn over the assets. We will need to get several attorneys opinion on where we as shareholders stand in this situation with our desire to move forward with a class action lawsuit. I think that we do have a strong case and I look forward to the shareholders having their day in court if we see chapter 7 happen next month. I hope that the boys can make a new solid deal that will best for all parties involoved. Then there will not be any need for lawyers. IMO
