once again, JD's PR language gives him a way out
From the PR cited by veno in a previous post (concerning the business deal with WW):
" *** The company has entered into an agreement ..."
From an online legal dictionary:
"Agreement: The writing or document that records the meeting of the minds of the parties. An oral compact between two parties who join together for a common purpose intending to change their rights and duties.
An agreement is not always synonymous with a contract because it might lack an essential element of a contract, such as consideration."
I went back an reviewed all the puff PRs (which, essentially, are all the PRs) and nowhere does JD ever say "signed a contract with .... ". It's too bad I didn't understand the legal implications of the wordings used by JD. However, most investors are not lawyers (as JD knows) and, frankly, the common-English understanding of his language continually leads the naive into thinking clear business deals have been signed. In fact, JD et al. have needed people to use common-english interpretation and not legalistic interpretation; otherwise, no one would fall for exph's pumps
Other than that, JD is a swell guy ....... :>)
