I agree that this is the best way to silence people. However, with the discovery going on with the hedgies and the noteholders (the very same people calling for this motion) at this moment, it would be completely contradictory for the judge to rule in favor of a Chapter 7. I wasn't a fan of her opinion on POR6, but I just don't see her doing a 180 in her courtroom and ruling in favor of a Chapter 7 liquidation at this point in time. I could, unfortunately, see such thing down the road if EC doesn't build up some real steam soon or if the insider trading discovery falls completely flat, but not right now.
