Usually the FBI provides an affadavit and does the arresting in a federal case, with the DOJ filing the complaint.
No question that the SEC can and does share information, but they don't hand out orders to the DOJ or involve themselves in the decision on whether criminal charges are filed.
The SEC files a civil complaint and the DOJ files a criminal complaint. Two different cases.
