Yes you are right.

If there is an investor that purchase the Asset at a fair market value and the asset is transfer to the investor then he owns it. However if he has not received the asset he could become a secured or unsecured creditor.

I suspect BEHL owns enough people to drive it to chapter 7. I might get this going just for the employee so they can get cash out of this. Then there is the clean shell if it comes out of the Chapter 7. If they do it right they can protect the shareholder somewhat.
