Johnik -- you nailed it which shows how laughable and sloppy the lawsuit is.
He claims in the lawsuit he never received his 100K shares which were part of his EMPLOYMENT agreement, shares he did receive from the company as an employee.
However, he filed a Form 144 on 9/29/10 to sell his 100K shares that he falsely claims he never got. You can get the report here:
"KAPLANIS, MICHAEL VASLEN FL 9/29/2010 Form 144 100,000 80,000 N/A / N/A "
He probably told his lawyer he never got them so that his lawyer would represent him on a contingency basis because just suing for his meager salary wasn't enough to get a lawyer to represent him.
