i think you have it the other way around. they were not able to seize a bank holding co's assets before, but now the FDIC gave it self these powers with the OTS out of the way basically.

I think what your trying to say is that the examiner is trying to use EX-POST-FACTO-LAW which he cannot. Laws do not work retro actively. So all someone has to do is point this out to the judge and his whole report falls apart on just one issue. The lack of asset valuation is huge as well.
