You're blowing this way out of proportion. Approval of the DS means nothing at this time. Examiner's report can change it in an instance. She's throwing nothing out. She promised that should allow a duel track to proceed in this case and she can't go back on her word.

The Adversarial Hearings are already schedule for Dec. 1st so who cares if they approve the DS now?
