Significance is in the eye of the beholder. This judge conducts his own Markman hearings and they are public. Any person attending will be able to see the offered claim construction by both sides. If you feel it is significant, then by its definition, it is significant. Maybe IDCC feels that the Lu claim construction is weak and want others to review and use in any litigation over the Tantivy patents. Maybe IDCC is kisiing up to a judge that does not like sealing documents in patent disputes. Maybe the judge said he would like the parties' claim construction documents be made public and IDCC filed the motion because they are the Plaintiff and Lu agreed to not oppose because it is good little defendant and they adhere to the desire of the judge. It just does not meet my definition of significant.
