The licenses do not cover 3g. Therefore, there is nothing to arbitrate with E/SNE concerning 3g. IDCC was just making sure that the arbitration clause that globally calls for this venue to handle any disputes between the parties does not include 3g infringement. You always want courts and juries to decide willful infringement claims.
