I have read that he was hired to focus on making progress in the North American market.

If true then a ban of Nokia products affected by the decision might make the new CEO look really bad because of what he was hired for.

Merritt seems convinced the new add on patents make our case stronger and if true Nokia should know the same. If Nokia knows they will eventually lose the logical thing IMO to do would be to tell their legal team to settle the case as cheap as they can and with that the Nokia board may see him as the right guy for North America.
