I think we are all speculating and guessing steel......The key word is "preliminary".....The good news inmho is that his final report will be confidential,distributed a week or so before the November 1st proposed deadline,and that's where the type of conclusions I think you are referring to will be.

Another poster said he believed that between Oct.27th and Nov.1st is when settlement will happen...

That's good enough for me,and I'm starting to look at flights for Vegas in late November........If anything happens at the hearing today(and we all know ANYTHING can happen at a hearing from past experience),that will be my deciding factor in "class of travel" to and from Vegas!!!

You addressed comments to Michael but here's my thoughts on them:

Yes, we have all studied and researched all of these issues for the past 20 months or so but the Debtor's legal counsel moved away from pursuing these issues. So now the Examiner SEES the merits of investigating these issues and is pursuing all avenues to find answers to them for the Court. He is now posting in writing to the Court what we have all posted at the Boards or to the EC, the EC Counsel, and the UST.

Two things ... 1) Since the Examiner has asked for a clarification from the Court on confidential information, he's not going to release anything that might cause JPM, FDIC or the Weil to go after him and disrupt the Exam; and 2) I don't see him releasing anything that has not been thoroughly researched and verified and there's just not been enough time.


In order for the Examiner to do a through examination and draw conclusions that can be supported, he knows what support he needs and how much time it takes.
