Show me a contract where it says that in the case of default and bankruptcy the senior creditors don't have the option to settle with whoever they want

The judge decides in BK, not the creditors. They present their cases and that is that. If CPRK can make a compelling argument to the judge that the DIP funds that have been lined up would give them a chance to emerge from CH11 down the road with creditors whole after payment plans, it would be a tough call not to let them give it a go.
