The judge decides in BK, not the creditors. They present their cases and that is that. If CPRK can make a compelling argument to the judge that the DIP funds that have been lined up would give them a chance to emerge from CH11 down the road with creditors whole after payment plans, it would be a tough call not to let them give it a go.
