Actually, while a TRO was sought, Sanofi consented to have the TRO consolidated with the request for a preliminary injunction. See Zipjet's message http://investorshub.advfn.com/boards/read_msg.aspx?message_id=53400860, which is based on the docket report. The judge never ruled on the TRO. I suppose it is technically inaccurate to say Sanofi did not seek a TRO but for all intents and purposes, in the telephonic status conference, they abandoned the request.
