How about because we on this board know more about the situation then these professional journalists who cannot get one story correct.

The immediately TRO was denied. Thank you.

Which, btw/ also indicates that the judge does not buy that generic lovenox is a danger to the public argument. Imagine denying a TRO when you know the result is tens of thousands of patients receiving the generic. The judge's ruling indicates that he does not consider this generic to be a danger of any kind as the public danger would be extraordinary if he had any doubt about it.

Whether or not the judge sides with Sanofi's statutory argument is something else and a technical reading of the statute, but it won't be because he considers the process botched or the drug dangerous.
