Great post William... the monthly billing statements are certainly VERY telling!! Thanks for putting Cussler on hold this weekend. The outcome of the 7th will likely provide specificity as to the timing of a future settlement date.

Excellent post and superior writing skills. Thank you for your analysis.

After being about two years in WMI BK case we are all emotional here and we always want to see/comment the billing statements on the direction we like.

Could it be that Solomon's numbers are not so good and Susman kept discussing with EC possible settlement which pays prefs. well but not the common?

Before I get a lot of heat on this post, I would like to remind you that I am all in WAMUQ and not pref., and I am preseizure holder. I just want top think opposite side of your comments not to put myself in another big dissappointment like the one with Rosen's so called funny golabal settlement!

Best to all of us and I TRULY want that we all get a nice settlement on this.

Postscript: The only aspect of the proceedings that the billing statement failed to address was the nature of the sealed document that turned the case on its head.

IMO

All of what you have deduced is predicated on the info obtained and assembled by EC before the EC obtained access to weil's Document database. According to the the EC filling of motion to file under seal, just 2 days prior to the 7-8 closed chambers meeting, the info to be filled under seal was obtained from the debtors. Now if I remember correctly the EC got into the database on the 7-2. Prior to that date Rosen was stonewalling all discovery


We are just going to wait for the July billing to come out to catch a clue on the sealed document/s. Going to be a hard long wait.

Very Insightful Post....But


William, excellent, well thought and insightful post, but one thing keeps ringing in my ear.


After all these "settlement" talks, both parties, especially the S.G. and Nelson cleary stated to THJMW, two hearings ago, that the meet and confer and discovery and settlement talks yielded no cooperation by debtors and they couldn't come to any agreements. This, I think was all after the month of June. With this open communication by Sussman, I believe it highly doubtful that they would purposefully mislead us (the shareholders) if, in fact, meaningful talks were leading to a meaningful solution or end. They would likely say that "we are receiving meaningful cooperation by the debtors" or something like that or nothing at all. IMO... Now.... July's billing will be the bombshell in telling just how much progress has been made since this June billing.

Great post, william. I agree with the overall majority of it, but the devil's advocate in me will question the implications of your fifth and sixth points. As noted, the EC has been in negotiation with the debtors all along, and not JPM and the FDIC. While I have no doubt a significant amount of groundwork was made in these negotiations, ultimately, the debtors are not the ones who will be paying the EC.

The one thing I find myself wondering is if the debtors are still running into issues with the FDIC and JPM; that is, they can't get them to pony up the funds to settle this thing, likely because the FDIC and JPM have their own dirt on WMI. I sort of think this might be the biggest cause of delay to getting this settled.

I'm still very much hopeful and of the belief that we will eventually get a hefty chunk of change back. The appointment of an examiner almost certainly assures us of that. How long it takes for him to find info that scares the debtors, JPM, and the FDIC into settling is what remains to be seen and will be the deciding factor as to when this case settles, in my opinion.
