I agree with you JH and ESSO deserve their day but to answer the last part of your question. If JH and or EESO have to pay a fine it will most likely put them out of business. I don't think either party has the funds to pay the SEC.

Why? 1) Because in his blind eye he has not done anything wrong. He just got Paid his Past Due Salary. That he doesn't want to pay back.
2) Because he doesn't have any money to pay any fines.
3) He has nothing more to lose, than more legal fees. That are being paid for by EESO.

Also here in the US, when All the other defendents plead guilty in a court case you may very well be proven quilty too.
The Young and Dumb Defense is not going to go too far. IMO

that is just for the court, someone can still have an opinion that he is guilty.....
