rramirez82, here's from 7/20 the dialog between UST and THJMW:

For me, there's little doubt that the scheduling for 8/10, concurrent with an already planned Omnibus for the date, means the "status report" will be during that Omnibus, in court, in OPEN court.

Your honor, there are certain variables that inevitably come up in this process i.e. conflict spreading and the like that presents, there's points that if i could make a promise today to the court i wouldn't want to be held to it. Like i said that the best we can do your honor is we understand the courts ruling with respect to time frame and we're going to do whatever we can to expeditiously to get the person on board. Alternatively your honor with respect to time frame I don't know if there is an omnibus date like later in august two weeks out that would be, provide a basis for a status conference post examiner appointment that would give the examiner a bit more time to wade through the documents that are available and prepare what I think would be a meaningful work plan rather then having what would essence be like a week or more to complete that task.

I think pushing it out to the end of august is gonna be difficult.

Creditors:
Again your honor Robert Johnson from Akin Gump on behalf of the official committee of unsecured creditors. we have to keep in mind the examiner motion was first made in April. There has been plenty of time for people to look at potential candidates. And plenty of time for people to look at issues and potential conflicts. We're gonna have names available for the trustee's office by tomorrow. And I respectfully meant that they should be able to get the process going faster than that, if they can get somebody selected by next Monday the 26th. Then they would atleast have ten business days before having to make the report on August 6th.

Walrath:
Well let me ask this, can the parties who are gonna submit names have the names they submit clear conflicts before they submit the names.

Creditors:
I can tell you on behalf of the creditors committee we aren't gonna put anyone on the list that we think has a conflict and we've been very carefully checking as best we can already and I believe that the others are similarly situated.

All right well, I'm gonna do this. I'm gonna direct the US trustee to get a person appointed by Monday the end of business on Monday the 26th. I'm gonna keep to my current time frame of the august 10 hearing and just for the record that's at 1:30 pm. But I'll hear whoever is appointed as the examiner regarding timing as I suggested. Thank You... All right we'll stand adjourned then.

EDIT- I'm sorry, my answer was wrong and it's the other way around - they're generally open to the public unless the court and/or subject matter requires the conference to be held privately before the Judge.
