As a fellow investor with significant positions in both Cerro and Medinah, I am recommending you reconsider your intentions here.
First of all, if something was shared with you in confidentiality and you post it publicly when you were asked not to, then I strongly suspect that you are burning a bridge that I wouldn't think you would want to be burning.
Secondly, if you have such a large position in the company, and if you trust the information that was given to you and you do, in fact, believe that we are very close to a deal, then why would you not trust the source of your information to release it to the public when it is appropriate to do so? How do you know that there isn't a very good reason for why the information hasn't yet been made public?
I don't think I know of or have seen one investor in either Cerro or Medinah who is not frustrated with the slowness of things with these companies. I have posted time and time again in various ways that if you believe in what is going on here then it is logical to trust the people that you have invested so much money in to make the right decisions and move forward when it is appropriate to do so.
I have heard, but am not certain, that we were close to a deal in the past with another company when some insider shared some sensitive information with someone they shouldn't have. That person made the information public and caused the company to pull out and the deal to fold. Are you sure you want to put yourself in a situation where you could be responsible for a similar scenario happening again? I sure wouldn't want to be.
I appreciate your desire to have things out in the open and to have the companies move this process along. I'm sure that you mean well. Unfortunately, sometimes the best intentions can do the worst harm, and I believe that is a possibility here. I would hate to think about how some of the people I have seen posting here over the years would react toward anyone who somehow managed to delay or screw up the progress of these companies...
Finally, in the event that you still feel inclined to follow through with the intended actions in your post, I BELIEVE that, whether the information is true and did come from the source you have stated, it cannot be construed as fact but only hearsay/rumor unless you have some form of documented evidence supporting your claims. I am not a legal person so I do not know exactly what the law states, but as far as me personally, I am very careful not to take anything posted by anyone on these boards as factual without finding supporting evidence on my own from a primary source whenever possible. Otherwise it's all just rumor to me.
Hopefully we are in fact close to a deal and the company is able to inform the public promptly. If not, as always, I choose to trust that they are making the right decisions since not one of us knows everything that is going on behind the scenes.
