I think the parties are not afraid of examiner but rather afraid that an examiner will cost extra delay which is extra money. This is pretty much what is going on now, the parties didn't settle with EC even with examiner assignment. If examiner is deadly for them, more deadly than paying for a settlement, they would have paid for it already. Remember ppl said there is no way parties will allow an examiner?
