Exactly right. The good thing for us is we've got one of the best lawyers in the world representing us. The UST is pushing for an examiner because the UST knows something stinks as well. We may be able to prove collusion. According to the Judge's conclusion in the Thykkuttahil case, the U.S. has the right to seize any bank if for the good of the country whether or not the bank had failed yet or not (I'm glad we don't have that Judge!) However, the law does call for "just compensation". The FDIC is not the Govt. but the OTS is. The FDIC put pressure on the OTS, whom eventually caved in and seized the bank. As some have said on here, the OTS may eventually be the fall guy. Now we are in BK court.....and we await "just compensation".
