You're correct about the post you mention having a flaw, but that's not it...

You write: If this company is a scam, then they will be definitely delisted from pink sheet and won't even show up in grey list. In fact, the stock is already "delisted," bounced to the greys.

If they can proof everything is correct, I don't see why not it will reappear on pink sheet. SEC just don't put the company with satisfied proof about their status on grey list. TOTALLY CONFLICT. If scam --> delisted --> behind the bar. No grey list. If legit --> relisted --> reappear on PINK.

There's no "proving" in that sense; broker/dealers already under the requirement to fulfill 15c2-11 to publish a quotation. If "it's a scam" that requires further action from the SEC, the next thing the public will see is notice of a civil suit (unless the company announces it's under investigation).
