There are some precedents (Kansas BK Decision 4/27/10 - FDIC NOL SJ Denied) where FDIC has been denied NOL moneys.

I think that could make the FDIC renouncing to the NOL money, and that would make an interesting amount that could be used to pay WMB bondholders.

1 and 2.- I sincerelly don't know if this money redistribution could be made in this current DS or they would need to file a new one, but I think they are going to work in that direction because both parties are interested on that. FDIC wants the bondholders on board and probablythey could refuse some money to achieve this goal. I am not legal expert in any way so I don't know the answer.
