It's been over 31 months now and the SEC has never offered a settlement for the company that we know of. Why not? Obviously the SEC doesn't want to settle...

You have no way of knowing what is or is not still being commited. We do know the SEC has uncovered more and more as the investigation transpired.

They have the same grounds they started with, plus all the other crimes that have been uncovered as the investigation moved along!

Of course not. Just as any prosecution rarely recovers its costs. When prosecution of this type runs up large costs they justify it with a conviction or in this case proving it was necessary to shut the company down.

"Do you really think the SEC brass is going to allow this circus to continue much longer?"

Of course, they would look like fools to end it now that they have invested so much and are so close.

And yet the process continues.

You cannot know that is true. You just hope it is.

3. The SEC cannot possibly recover their costs of litigation from the company under their current financial state.

The SEC is not a "for profit" entity. It's a policing entity aimed at maintaining a fair market, free of corruption and abuse. Which is exactly my they have this company in their sights.
