I just got a little happier after reading this. I read through the first motion (and found a typo...). It seems to be logical and well written. Ashby and Susman have a good argument. The only way Rosen could fight this is by saying it'll waste more money of the estate and more time. If the parties haven't been fair with the discovery process, then THJMW most likely won't agree with that argument. It would save WMI time and money to hand over the damn documents rather than playing a game of cat and mouse...
