Hello jpm,..my interpretation of that passage I pasted was that the Examiner was the one who would be put in place to determine exactly what improprieties are happening here.

I wonder if the results would have been different if the UST was the one who actually initiated the request for an examiner. In this case, as I recall, the UST only supported the EC motion for one.
