Of course attorney usually wants to settle rather than go to trial because he doesn't want to take the risk of losing the case, even if the possibility is really low. However such an attorney might not represent the best interest of his client.
For IDCC, I'd rather stand firm on 2G money and go for arbitration than curve in and settle for less (of course I think I can take some discount of 2G rate if we can get 3G rate settled).
