I just don't feel that the filing on Wednesday regarding the removal of Moody's from the list of those to be examined as witnesses or to produce documents is as simple as they are just complying with the production of documents.

If so, the lawyers would have filed motions similar to those for Blackstone and OB-C (filed on 12/30) stating Service of Production of Documents. Knowing what happened with Moody's downgrading of WAMU, I believe there is possible culpability on Moody's part if they submit any documents or have to testify. I think they made a separate deal with WMI lawyers to protect themselves, thereby being removed from the production list.
